I am Belgian, married in Belgium after 10 years of living together with a Thai woman. She now also has Belgian nationality. Since I will retire in March 2021, I would like to leave for Thailand for a longer period. My wife would like to go in January for family reasons.

Now I would like to declare my Belgian marriage in Thailand. Can my wife do this alone with the necessary documents without my presence? And can I apply for a marriage visa in March?

1. I think it will suffice to present an extract of your civil status proving that you are married to obtain your Non-immigrant O based on Thai Marriage. Can you get it from the municipality.

On top of that, your wife will also have to prove that she also has Thai nationality.

But it is best to contact the consulate in Antwerp or the embassy in Brussels whether this is sufficient as proof of marriage. Do you immediately have clarity.

Of course you can also apply for your Non-immigrant O based on Retirement. If that is already possible, of course. For your extension later in Thailand, it also does not matter in which way (retirement or Thai marriage) you entered to apply for an extension later. Can be based on Retirement or Thai Marriage. If you meet the conditions of your choice, of course.

2. As far as registering in Thailand is concerned, I suspect you will have to be there, because the necessary documents will have to be signed. This registration in Thailand is indeed necessary if you want to apply for an extension based on Thai marriage. After all, you must submit a Kor Ror 22 for this and you can only obtain this if your marriage is registered in Thailand. Normally if the marriage was performed in Thailand it is a Kor Ror 2 – Copy of marriage Certificate. A Kor Ror 22 is the same but means that the marriage took place abroad.

    I got divorced in Thailand without being there.
    First divorced in Belgium, then with legalized and translated papers to Thailand and transferred there.
    I think you can do the same for your marriage.

    In my humble opinion and with the experience we have, it is better to do all administrative tasks at the Embassy in Brussels and then together with your wife,
    The representatives at the Thai embassy are helpful in finding the appropriate solutions.

    Once the necessary documentation is in order, your wife can, of course, leave earlier if desired.
