We have now applied for a Schengen visa twice for my Thai sister-in-law and her three-year-old son. My wife has been living in the Netherlands for 16 years and she would like to invite her sister and nephew for a holiday. No success. The reason is that the Dutch embassy doubts that she will return to Thailand.

Appearances are indeed against her because: no job, no husband, no homeowner. The child is 3 years old, so it is not yet compulsory to attend school. She does take care of her elderly parents, but the embassy does not think that is a valid reason.

I have sent pictures of our band and an accompanying story. And the financial conditions are also in order. So I don't get it anymore. Do you have any tips/examples that I can apply when objecting to the IND?

Dear Tom,

In her case it will be difficult but not impossible to obtain a visa. However, the decision officers want to see concrete, verifiable evidence that supports someone's promise that he/she will return in a timely manner. Unfortunately, you have little concrete to discuss.

In your case, I would advise you to contact an immigration lawyer and have them make the objection. They also have experience with these types of situations and can therefore write a good objection much more easily. Look up some of them via Google, for example, or look at the banners on the website of internationalepartner.nl. And then choose an immigration lawyer who falls within your budget and gives you confidence.

NB: in various other situations I have advised readers to lodge an objection with the IND (by myself or with an aliens lawyer). Unfortunately, I never really hear how that ended, let alone examples of how people (successfully) lodged an objection. An example of an objection will by definition be difficult because every situation is different, you actually have little concrete to tell the officials.

    Otherwise, let the sister-in-law come alone first. Then the probability that she will return if her child stays in Thailand is more easily met. How long will she be here? One month or maximum90 days? You can lodge an objection with the IND by means of a normal letter and any additional information. They are probably over the legal term and have to pay. And then it can suddenly go very quickly. The IND must be given notice of default. Advice from the IND operator. 🙂 A few days later they agreed. January 2019. I did contact the IND by telephone a few times.

    Meanwhile, thousands of asylum seekers / fortune seekers are streaming NL. inside. (without visa)
    VFS globally not a success, given the long waiting times and the uncertain outcome.
    IND understaffed, cannot be otherwise given the above.
    I wanted to go on holiday to NL with my Thai wife, and I am starting to believe more and more not to do this.
    Finances in good order.
    Where is the service of Thai embassy , arrange it yourself.
    Finally, I pay tax in NL. , without getting much in return.
