Call: Reader wanted for AOW tax file

I have agreed with the editors of Thailandblog.nl that I will make a tax file. It will be the 'Tax file AOW-ers' and it will be about people with AOW/pension/annuity from the Netherlands who have emigrated to Thailand or are going to emigrate.

Those who do not yet have an AOW pension but can benefit from WAO or pre-pension. The file is not intended for people who live and work here temporarily.

There are misunderstandings about the formal provisions regarding the tax position of these groups. A few days ago, views were given in this blog that find no support in treaty and laws. I want to treat in that file in a question and answer format:

  • The Dutch national legislation after emigration.
  • The tax treaty (let me call it, the official name is different) between NL and TH.
  • Thai national law to date.
  • The current bill in Thailand to change the law (but this will be delayed by the coup).
  • How the Netherlands is now dealing smoothly with a treaty article.
  • How Norway is already solving the latter together with Thailand.
  • The application for exemption and, if rejected, the notice of objection.
  • The levy on annuity and golden handshake.
  • The levy and exemption on pensions of companies that have been privatized.
  • And what readers bring.

And when I have explained the formal situation exhaustively, you will see that tax officials work in many provinces of this country who know nothing about the tax treaty. Who, and that has happened, send farang away with a face of 'How difficult, a farang who wants to pay taxes'.

I'm looking for a corrector, reviewer, to read the drafts later and that is preferably someone from the tax and/or legal services. The editors have my email address.

      Hello Eric.

      A good initiative and much needed, given the many misunderstandings and opposing opinions on this subject, as you could read in this blog recently. And when I see the topics you want to cover, I immediately see that you are on the right track. Behind a number of topics are various court decisions.

      I am quite willing to read the drafts. So far I am mainly concerned with my Philippine clients for income tax purposes. However, the Netherlands-Thailand tax treaty does not contain any essential differences compared to the Netherlands-Philippines tax treaty.

    I think this is a great initiative. About 2 weeks ago I had already asked a question about the state pension in Thailand, but then it turned out that there were various opinions and advice. When I was then referred here, via SVB Breda to SVB Roermond (where the Thai files are apparently handled), I did not receive a definite answer to my question about “aow benefit in Thailand” either.
    You will therefore be of little use to me in terms of “aow knowledge”, but I will follow your achievements in this with great interest; as well as many others, I'm sure.

    It seems to me that the name of the tax file has been chosen incorrectly, because people with only state pensions have to deal with simple regulations regarding tax and are misled. I would also like to point out that the example chapters only concern those written out in the Netherlands.

    Why not call it by its name: 'Dossier Tax Treaty Netherlands-Thailand'?

    I applied for state pension from the SVB in September 2013 and provided my home address in Thailand. SVB is in contact with the tax authorities in NL (Roermond) and they are aware of whether you have officially emigrated. That must absolutely be known and accepted there. They are also in contact with your pension funds in the Netherlands from which you receive a pension benefit. After approximately 2 months you will be notified how your AOW will be calculated, what the deductions will be and what will be paid out. The same story applies to pension funds. They serve more and more retirees abroad and are exactly aware of what needs to be kept in mind. It becomes a lot more complicated if you receive other benefits, but for a Dutch pension and AOW it is all fixed. AOW and Dutch pensions are currently taxed in the Netherlands, which may well change in the future, but it is difficult to guess what that will look like at the moment.

    “…people with only state pension…” Please take a look at the second sentence of the announcement.

    It says "AOW-ers" and that is the group that has AOW and next to it, or not, pension or annuity. They can be compared to people like me: AOW and pension.

    Your suggestion “…Dossier Tax Treaty Netherlands-Thailand'…” is also about people who live and work here temporarily and I don't want to include them for the simple reason…

    – that people posted abroad can often get tax relief for NL and TH through their company/government
    – that I have no knowledge of progression reservation in Thailand (and cannot find it anywhere)

    and so I don't want to include people with income from current work earned in Thailand.

    I am purely concerned with pensioners and their tax position in NL and TH.

    I hope it will be a total picture of pension, obtained from:
    – AOW (mi taxed in NL)
    – company pension (in my opinion not taxed in NL, gross = net)
    – annuities/living annuities from a single-premium policy and/or golden handshake (minor change in progress; levy in NL).

    I am not a civil servant myself. I have heard the bell ring: sometimes I have the idea that slightly different rules apply to civil servants and ABP with regard to pension deductions. In that case, I hope that the principles of the project are clearly stated and any necessary distinction is clearly indicated.

    A document is often a snapshot. Hopefully, the document will become the basis for a living document, so that subsequent legislative changes and advancing insight can be incorporated and communicated to readers as update(s).
    Please also include a source reference at the end: list of names of organizations and possible inclusion of website names, where people can obtain more information if they wish.

    In my opinion, it falls outside the framework of the project, but it would be nice if a short (1 A4) general summary could be given at the end of the "exhaustive" document, which quickly provides insight into the advantages and disadvantages, financial (pension) consequences of whether or not to emigrate (unregistered from NL).
    Other criteria that are important in the choice between emigrating or not, such as differences between NL-TH with regard to the tax on savings (some people do not yet live on pension/benefit but from savings), from NL basic health insurance to expat insurance, etc.
    In this way, an even more balanced decision on whether or not to emigrate is possible.
    But I more than fully understand if that is not taken into account. The current job seems comprehensive enough to me. Good luck with that.

    What a great plan. I had asked the question about taxing my pension and indeed received very well-intentioned advice. But they also contradicted each other so I didn't really get any wiser. Despite that, I would like to thank everyone for thinking along. The blog certainly does not lack enthusiasm among the readers

    Commendable initiative! If Belgian does not apply to me, I am also well away from retirement. Anyway.

    Kudos to the initiator. If you surf to 'files' on this blog, you will always come across well-discussed and commented articles. That helps people who want to know just that one thing!

    Furthermore, reader questions have been asked so many times about this subject, and the responses to this, whether or not personal experience, are sometimes a jumble of contradiction and know-it-all. It's nice that this is now being thoroughly investigated so that solid information follows.
