Here next to me is a German friend, who has an overstay of 2 months. Can you tell me what the consequences are of this, and what else he can do to prevent worse?

PS. he thought he had a visa for 6 months, and did not pay attention to his stamp.

What he has to do is leave Thailand as soon as possible. This will have to be done via an airport. Crossing a land border may not be possible given his overstay.

Since it is less than 90 days, it will probably remain with a fine of 20 Baht and a note in his passport. Does not normally affect subsequent entry.

However, if he is arrested before he has left the country, he can receive an entry ban of 20 years on top of the 000 Baht.

I hope he can also pay for a ticket or he can spend some more time in a Detention center until he can show it.

What I'm giving now is what I personally expect. What ultimately awaits him will be decided by immigration.

Summarizing the rules.

Thailand's immigration law says, "Any foreigner with overstay can be punished with imprisonment up to 2 years, a fine of up to 20.000 Baht, or both".

In practice, it will amount to 500 Baht per day, with a maximum of 20 Baht.

Serious penalties have been added to this as of March 20, 2016.

In the event that a foreigner turns himself in, the following penalties will apply:

– Overstay of more than 90 days: no entry to Thailand for the period of 1 year.

– Overstay of more than 1 year: no entry to Thailand for the period of 3 years.

– Overstay of more than 3 year: no entry to Thailand for the period of 5 years.

– Overstay of more than 5 year: no entry to Thailand for the period of 10 years.

In the event that a foreigner does not report himself and is arrested:

– Overstay less than 1 year: no entry to Thailand for the period of 5 years.

– Overstay of more than 1 year: no entry to Thailand for the period of 10 years.
