The chief responsible of the land office in Pak Thong Chai refuses to register a usufruct because I am not married to my girlfriend. A while ago I had a house built on a piece of land owned by this friend.

Is madam in charge right? If no, what can I do?

    In Khon Kaen I have a lifelong usufruct registered on a title deed of a piece of land owned by a friend, so legally there is no problem.

    I have no idea how to convince a person in charge of the land office of this.
    That will depend on why the person in charge refuses that usufruct.

    I did the same with my girlfriend's piece of land for two years because I was going to build a house on it. No problem.

Copies of passport, some forms filled out and done. This time I don't have the right to use it, but it can't be sold without my permission.

    Although the law does not prevent Foreigners from being able to apply to register a usufruct on a land, however, this is still subject to the discretion of the Land Officer.

    Land Office Khonkaen is no problem.

    When we bought, the lawyer advised me not to ask for a usufruct because it might be refused because we are not married. It has become long-term rent with a note on the chanoot.

    Usufruct is particularly suitable if you are not married because it is a business agreement and is separate from family law, I mean you can conclude it with anyone.
    My tip, go to a larger office of Land Office such as in Korat city because it is well known there, I think unfamiliarity plays a role in Pak Thong Chai. You are not local or municipality bound in land/house transactions from the Land office because it is just a central database that is used to record everything.

      I have to go to the land office every year to pay the land tax.
      Because my wife has land in different places in Pakthongchai,
      do i also have to go to two different country offices .
      What I want to say , there are 2 land offices at Pakthongchai ,
      if it doesn't work at one, go to the other office
      and try there.
      And otherwise , Khorat is not far away .

    Seems like a misguided position on the part of the officer to me. Does that person want to see money? I think you can also conclude such a contract with a complete stranger. Otherwise, just hire a lawyer; that will undoubtedly help to convince that official.

    It is best to conclude a usufruct if you are not married. Any agreement entered into during the marriage can be undone. So also the usufruct. But if the official in question does not cooperate, it will not be of much use to you.

    Dear blog members, I would also like some information regarding the formatting of the Usufruct. I bought a Condo in Pattaya in 2014, last year I had the condo transferred to the name of my Thai wife, because then there will be fewer problems if I die. I also wanted to have a Usufruct drawn up in the land office of Pattaya, it was also refused. We live in Nongkhae, Saraburi District. can I go to the land office there to have the Usufruct drawn up or can this only be done where the property is located. Is anyone aware of this? If this is not possible, which head office could I still go to to have the Usufruct drawn up. Please? Thanks in advance.
