Thailand question: Buy condo in Jomtien/Pattaya

Dear readers,

I am considering buying a 2 bedroom, 2 bath condo in Jomtien/Pattaya. Now I see that the condos on Thai name are much cheaper than on Foreign name.

What are the differences and what are the objections to buying a condo in Thai name?

Also the question: how much can you haggle on the asking price?

      From there I want to look to buy a condo, in Pattaya/Jomtien, or on the west coast, Khiri Kahn, the native region of my Thai Sweetheart.

    My advice would be to rent something first, there are so godforsaken many condos for sale in Pattaya. Rents are also under enormous pressure, so you can rent a condo for next to nothing, and then you can look around at your leisure…

    I think it's something like this:
    In Thai name: you have to set up a company, pay taxes for it annually. And condo in Thai name is more difficult to sell to foreigner, because foreigners prefer condo in their own name (but there are always exceptions).
    Advantage: cheaper and less transfer tax (because the company is sold when buying/selling).

      i think it is not correct. Buying a condo in thai name is probably what it says: a thai buying it. Buying a condo not in thai name is just not thai buying. Buying a condo through a Thai company is probably the third option usually used for situations where a foreigner cannot be a buyer. That is, for example, a house. You cannot buy the land as a foreigner. The last variant is not without risk. That is why it will not be used so quickly when buying a condo. As far as I know, a condo can only be sold to foreigners if 51% of the condos in the building are sold to Thais. The 49% may then be sold to foreigners. To persuade those 51% of Thai buyers, the trick may be to keep the selling price low for them!

    I myself also have bad experience with fellow compatriots with buying and selling and maintenance etc of real estate in Thailand. Dutch people, we remain traders.

    Buy condo think more like 10.000 for sale here in Pattaya. And there will be many more in the short term. It has become a small Bangkok during the corona time. There's a condo construction virus. But here “it seems”” almost everything is empty.

    Good advice has already been given to you in the comments above. There is absolutely no difference between buying on a Thai or foreign name; however the procedure explained below may apply.

    Anyone can legally buy and manage a condo in Thailand. That does not apply to houses and land.
    The only rule that the Thai government has established is the 49% / 51% ownership rules.
    This means that in a condominium building or complex no more than 49% of the units may be managed by foreigners.
    Furthermore, the rule for foreign buyers is that the money of the entire purchase price must enter the country through a Thai Bank, the bank will then provide a Tor Tor Sam.
    The Tor Tor Sam needs you again to legally place your name on the Chanote (Tittle Deed) of the relevant condominium at the Land Registry office.
    Without Tor Tor Sam it will be very difficult, but perhaps on a Thai name, with the possible long-term consequences if the relationship breaks.

    Buying real estate through setting up a business only applies when it comes to land with or without a house, as foreigners cannot buy land under Thai law. However, this method is also known by the land registry office and questions are often asked who and why foreign Thais suddenly become shareholders who have virtually lost their voting rights.

    If you buy a condo, pay particular attention to the details of things in the condo that we all consider self-evident in the Netherlands, such as drains from showers and sinks, which have gooseneck drains. It may sound strange, but many Thai condo drain pipes go straight down and can cause unpleasant odors. Are all electricity switches and sockets earthed? And watch for signs of termites.
    Consider how much sun the condo gets and at what part of the day. How old are the air conditioning units.
    Good advice is indeed to rent something somewhere and then look around at your leisure.

      I would add that once you've found a condo, it's a good idea to look at it at different times of the day. In the morning, evening, late afternoon, to realize what's going on.

    There are 3 ways to buy or register a condo in a condominium, as described above.
    The Thai name needs no explanation, disadvantage if you leave your partner you cannot claim any compensation.
    The Farang name is clear: you can sell to anyone.
    The company requires some more explanation which I would be happy to provide to you at your private email address, my address is [email protected]

    About the prices: Thai name, as said above, often unfinished or in Thai style. Without a kitchen, for example. Or on an unattractive side of the building, etc.
    Farang name: often the most favorable places with, for example, a Western kitchen, etc.
    It makes no difference to company. You buy what you want.

    To try I wouldn't buy from paper or website. Brokers drag you everywhere they care about the commission. (Also with rent).

    I can offer you a 2/2 with central living room and kitchen on the top floor of paradise park in Jomtien for rent for an indefinite period and option to purchase. 3 air conditioners, 2 fans, 2 TVs, fully equipped. This way you can have a good overview of everything.

    Some specifically about what's on offer in/around Pattaya.

    You can turn on the subtitles to follow it better.

    Examples: “Rides 4 Kicks” or “Jett Gunther” … Especially Jett, half Thai/half American, is very informative
