Reader question: Number of questions regarding the new land tax
Dear readers,
I read that there would be an exemption of up to 50 million baht with the land tax to be introduced. Is that the maximum for a first property? Or total of properties?
For example: 1 villa of 40 million euros is exempt from land tax.
For example: 2 houses of 200.000 THB, 2nd house is not exempt from land tax? Or do you?
How will one determine whether land is just agricultural land (low tax) or derelict building land (high tax). In Thailand you can build just about anywhere…

Second house is not exempt and given the value indicated in the example, 0.03% tax will be levied on it. For a nice representation of the "new" tax vwb land and house see the following site:

To determine what is agricultural land or not, you can inquire at the "cadastre" (land office) if at least the land is described there.
How will one determine whether land is just agricultural land (low tax) or derelict building land (high tax). In Thailand you can build just about anywhere…
In Thailand you can NOT build just about anywhere. In the past, there was a lot of "cheating" and, subject to pocket-filling by the Land Office officials, land was often given a different destination. Just look at what is happening right now: many of these illegal structures are being razed to the ground. Do you still want to take this risk today?
As for the land tax: it already exists, but now it is collected by the Ampheu to which the property belongs. Father State wants to collect this income and use the money where it is needed. The figures, as far as exemption is concerned…. 50.000.000THB…. I do have some doubts about that, because that would mean that virtually nobody would pay land taxes nationwide. Rural there are few properties of this value, unless somewhere a rich farang with a villa of 40.000.000 THB, which is usually not his property.
