Do my Thai partner's divorce documents need to be translated?
Dear readers,
Next week I have an appointment at the Dutch embassy regarding an intended marriage with a Thai. I have all the documents required, however my soon-to-be has been previously married to a Thai.
She has the divorce documents, do they need to be translated into English for inspection at the Dutch embassy?
After a long search I can't find a clear answer to this question. Maybe a reader has an answer.
Regards,
Gert
Editors: Do you have a question for the readers of Thailandblog? Use it contact form..
Hello Gert,
I'm going through a similar process, except that my fiancée has not been married.
You need a Letter Of Marital Satus Certification.
This is issued in the other half's hometown.
teH is a Thai document, and must be translated by a sworn translator and then legalized by the Thai Ministry Of Foreign Affairs.
I don't want to scare the road but this process can take 5-10 working days…
Good luck and congratulations in advance!
Why not contact the embassy then wait for tons of different answers/responses.
I have submitted this question to the embassy via email. The response consisted of a link to a government site with general information about getting married in Thailand, but no information about divorce documents.
Gert,
The Dutch embassy in Bangkok is anything but a rock in the surf for compatriots.
Your significant other only needs the Letter Of Marital Satus Certification. The declaration therefore that she is not (anymore) married and can legally marry.
By the way, if, like me, you are a real Dutch person who has emigrated, then you need a Certificate of Authority to marry.
Contrary to what I expected, you don't get this at the embassy, but from the municipality in the Netherlands where you were last registered.
This is the information I received from the Netherlands from the civil registry of “my” last municipality in the Netherlands:
"" "
You can indeed only apply for this statement in your last place of residence in the Netherlands.
For such a statement, we need the following documents from both of you:
• A copy of a valid passport or ID card
• An (international) extract or copy of the birth register*
• An (international) extract from the population register* of your current place of residence stating your name, address, place of residence and marital status.
• An (international)* extract or copy of the last divorce certificate* (if applicable)
• A personal declaration of marital status (see attachment)
*translation of the document is required if it is not in Dutch, French, German, English or Spanish.
If it is a document from outside the EU, it must also be legalized.
See Legalization of foreign documents for use in the Netherlands | Living & working | Netherlandsworldwide.nl | Ministry of Foreign Affairs.
If you have the documents translated in Thailand, the translations must also be legalized.
Once you have collected these documents, you can scan them and email them to us for initial assessment. If approved, the originals must also be submitted, for which an appointment must be made. You can authorize someone in the Netherlands to do this for you. You write an authorization for this in which you state your own personal details and those of the authorized representative and sign it. You give the signed authorization to the authorized representative. The costs for a certificate of legal capacity to marry are € 24,60.
"" "
It's quite a puzzle but in the end it's doable 🙂
