The distribution of pensions for partners getting divorced is being modernized. This is the aim of the pension distribution bill parting 2021, which the Council of Ministers has approved on the proposal of Minister Koolmees of Social Affairs and Employment.

When the law is introduced, both ex-partners will have an independent right to part of the old-age pension that they accrued during the marriage. This gives ex-partners more insight into what their financial situation will be after retirement. This amendment to the law breaks the lifelong dependency between ex-partners in the field of pensions.

After entry into force, pension providers will automatically distribute the pensions as soon as they receive notification of a divorce. Ex-partners will soon be able to indicate if they do not want to divide the pension. They can also make other agreements about the division together.

The Council of Ministers has agreed to send the bill to the Council of State for advice. The text of the bill and the advice of the Council of State will be made public when it is submitted to the House of Representatives.
