Dear readers,
I read on the Pattaya One website that 100 late-night freelancers (prostitutes who don't work in a bar) were recently arrested from the boulevard. And from my previous experiences in Pattaya, it turned out that they are not very approachable.
Are they punishable and to what extent is there active prosecution? Why are the police targeting them and not bar employees?
And importantly, are the buyers of their services punishable? Does this apply to all of Thailand?

The law below still applies. You could read Section 6 in such a way that customers of prostitutes are also punishable. The rest of this law is mainly about giving the opportunity to prostitution, human trafficking, child prostitution and setting up organizations to combat this.
It is well known that the police and military profit heavily from the opportunity to prostitute. So why would they bother to close these establishments? And the 'freelancers' are arrested and released after paying a fine. Checkout!
PREVENTION AND SUPPRESSION OF PROSTITUTION ACT BE 2539 (1996)
Section 5. Any person who, for the purpose of prostitution, solicits, induces, introduces herself or himself to, follows or importunes a person in a street, public place or any other place in an open and shameless manner or causes nuisance to the public , shall be liable to a fine not exceeding one thousand Baht.
Section 6. Any person who associates with another person in a prostitution establishment for the purpose of prostitution of himself or herself or another person shall be liable to imprisonment for a term not exceeding one month or to a fine not exceeding one thousand Baht or to both .
To associate can be translated as dealing with.
To associate with someone:
to be friendly with someone; to be acquainted with someone socially in a work setting.
Sex does not (yet) have to be involved.
The intention of paid sex seems sufficient.
It also says himself, her self, or ANY other person.
I don't think that applies to the customer, but to the madame who runs the brothel.
If it applied to the customer I would use THE other person.
Moreover, this article 6 only seems to apply to a brothel (in a prostitution establishment). (or maybe a massage parlor)

As made clear in the previous response, there is a law regarding prostitution. Why are the so-called freelancers being tackled and those who work a bar are not. Very simple: the freelancers do not pay a “tolerance fee” to the police. The bar owners do. It is then usually on the complaint of these bar owners that the freelancers are tackled every now and then. The bar owners pay and see part of their income (bar fee) lost to the freelancers. The police must demonstrate that they do something to justify their tolerance.

Strictly speaking, a bar isn't doing anything wrong.
The ladies are companions to make the bar cozy.
If you want a night out with one of the ladies, it is obvious that you compensate the bar owner.
After all, the bar becomes less attractive.
What the customer does with the lady after they have left the bar is not the owner of the bar and is not his responsibility.
These freelancers offer their services in a place where tourists are regularly robbed by, yes, those same girls who are not always girls but kathoy.

The government wants to clear the name of Thailand from the bad image it has abroad because of the sex industry. The government is calling for the industry to be tackled, so what could be easier than to pluck the prostitutes off the beach paths with a show of force. They are taken to the police station and with the exception of a few who have to stay overnight, the rest after payment according to ability of 50 to 500 baht around midnight outside the police station.
The government can show that they are being dealt with, but the next few days it will be business as usual again.
