Dear readers,

We are building a house in the province of Surin, but the contractor is constantly stringing us along with empty promises. The house should be ready in 2 months, but he won't make it. Can we cancel the contract? How then according to Thai law?

    Dear Ghi,

We have experienced the same in Surin.
Our contract consisted of partial payments after advanced work.
To have this contract dissolved, I advise you to go to a lawyer in your area with the statement that you want to get rid of the contractor and terminate the contract.
He will then give you a letter that you will push under his nose by appointment with your contractor.
Please note that you will probably still have to pay an additional amount, so check with your lawyer.
This is because the last (or previous) partial payment contains works that have already been made.
He digs through your contract, he also reads through the fine print.
We pushed this copy under his nose and had to make a small additional payment. At first he didn't agree, but after I threatened to take this a step further, judge, he completely backed down. A letter from your lawyer is therefore important, it shows that you were not born yesterday and are strong. If you don't do this, he won't want to get out of the contract with all the hassle afterwards.

    Succes

    Dear Eric,
with partial payments, the word says it all, you pay for a specific route.
eg, foundation, you pay in advance and when this is done, you negotiate the next route, etc.
At least that's how I do it.
I am also running into problems. eg poor finishing or wanting to start the next project while the previous one is not yet finished.
Just to collect the next budget.
Perhaps it would be wise to talk to the pujabaan.
Maybe he can sit down with you and the contractor.
If you want a different contractor, don't forget that this will also cost money again.
I've also been on the verge of quitting several times, but I kept going anyway.
Also on the advice of the pujai job.
It all takes longer than agreed and sometimes they also have another construction project running without people being aware of it.
I think that many farangs have run into the same problems or will run into them.
Sometimes it's cringeworthy or worse. Building a house the Thai way with a good western shot often causes problems.
I wish you wisdom and strength in this.
