I had previously asked you about my immigrant O visa based on retirement. I would then choose the bank method. My question is about home ownership. I have been married to my Thai wife in community of property for over 23 years. Money is released upon emigration and I want to buy a villa/bungalow in my wife's name.

When granting my visa for one year (TB Immigration info letter 024/19 – The Thai visa 8) I have to hand over various papers regarding the house

  1. Copy of own Tabien Baan (if owner)
  2. Copy rental contract (if tenant)
  3. Copy ID card of the person who accommodated you and signed by that person. (if tenant)
  4. Copy of Tabien Baan landlord and signed by that person (if tenant)
  5. Copy of title deed landlord (if tenant)

If I have understood correctly (I also watched a film about the yellow book by Eugeen on YouTube, my wife will receive a blue book at the Amphur. According to Eugeen, only the Thai are mentioned in the blue book. According to this film, I would could be eligible for a yellow book, would I then only have to comply with points 3 and 5 plus the yellow book in which I am listed at the address for my visa extension?

The list I mention in TB Immigration info letter 024/19 is what may be requested. That often differs from the immigration office.

Every address in Thailand has a blue address book. This is the main document and mandatory, otherwise the address does not exist. In that blue booklet only the name of the Thai who is registered at that address is entered. A foreigner may not be registered in that booklet. If it did happen, then it's an error on the part of the municipality. What the municipality sometimes does is write the foreigner in pencil. This is for informational purposes only and has no value.

What the foreigner can do is request a yellow address book. Is just the same as the blue book but for foreigners. You will then officially enter with your name in Thai. You can request the yellow booklet at the municipality. Here, too, the application procedures may differ from municipality to municipality.

Foreign owners usually have a blue book with no name or only in pencil. Or they have a blue book with nothing in it and also a yellow book with their name in it.

When applying for your annual extension, your wife will have to show her blue address book with her name + copy. In addition, her ID with copy. She is the main responsible of the address. Do you have a yellow book yourself in the meantime, you can also show it and a copy of it, but it is also possible that immigration does not even look at it. That yellow booklet is also not an obligation to have. Depends on your immigration office.

If you are married but you still ask as “Retirement” usually the blue address book and her ID will suffice as proof of address. Proof of ownership is usually only available when renting and if it is already requested
