I have not lived together with my Thai wife for more than 1 year now, with whom I have been married for more than 10 years. She flatly refuses to officially divorce despite frequent requests. I have been living with my new Thai partner for over a year now.

I am planning to go on holiday to Europe with my girlfriend for three weeks. To do this, I have to sign the Guarantee/Accommodation Form at the Dutch embassy. My still legal wife also has to co-sign. She flatly refuses, so that I get into trouble when my new girlfriend issues the Schengen visa.

Dear Peter,

Because you are married, he must indeed also sign for a guarantor and/or accommodation. If she doesn't want that, two options remain:

1) Your girlfriend demonstrates that she has 34 euros per day to spend on her own money and arranges your stay in the Netherlands in such a way that you do not have to provide accommodation (someone else will arrange the accommodation or take a hotel).

2) Someone in the Netherlands guarantees her. This person (or another person) can also provide accommodation. This can of course raise questions, so make sure that the guarantee and/or accommodation is plausible. Perhaps a close relative of yours would like to vouch for this or another person you know well and it would not be strange if they help you. Of course you also explain this in an accompanying letter in which you, as the sponsor, explain your relationship to the foreign national (your girlfriend), why you are going to the Netherlands and why your girlfriend will certainly return to Thailand.
