Dear readers,

As I recently reported, we have a massage shop in Krabi. I put in most of the money and my partner does the work. Because that's not allowed, I'm not cooperating. Yes, in the start-up phase I sometimes rolled up my sleeves, but that's about it.

My question is about the work permit. I cannot find on the internet whether it is possible to obtain a work permit for our own shop. I don't think it falls under the categories that foreigners are excluded from. No other people work in our shop.

I can't work for my partner either. But can I get a work permit as a co-owner?

    Of course I don't know for sure, but I think this falls under * work that can be done by a Thai * and is almost always done and so (again I'm not sure) you won't get a work permit for this. But otherwise ask at immigration, they can probably help you further

    If you wish to start your own business, then you can obtain a work permit for yourself by setting up a company, employing Thais (normally 4 per work permit), paying yourself sufficiently (minimum of 50,000 baht per month for foreigners), and paying all taxes.

    Minimum registered capital for a company must be 2,000,000 baht per work permit, or 1,000,000 baht if the work permit applicant is legally married to a Thai.

    You can always set up a company and apply for a work permit as manager of that company. However, you will not be allowed to do the executive work yourself. The question is, of course, whether the costs (all added up, it is quite a bit for Work Permit, perhaps Business Visa, 4 Thai employees for which social security costs must be paid, a mandatory minimum salary for yourself of 50,000 baht, etc.) outweigh the the benefits. Because what will your efforts/presence bring extra to the business?

      I am indeed asking the same question. So you have to be very sure of yourself. Otherwise, you could end up with a serious financial hangover.

      Does the Thai partner already have work experience in a (Massage) shop? Does she know anything about doing business in Thailand?

      I think it can be very useful to inform the insiders well in advance about this.

      Personally I think it's a risk. You must employ 4 Thai. I also see potential problems with that: there are well-motivated Thais and there are 'smartphone' Thais (by which I mean Thais who are almost constantly on Facebook)…
