Dear readers,

My brother married his Thai wife in Belgium. There has been no Thai marriage. He passed away last year. Now his widow wants to register the marriage in Thailand so that he can also go through life with his surname.

Does anybody have experience with this?

Is the official legal European marriage of a Thai national recognized at all? What steps should she take?

Regards,

Leon

    Dear Leon,

    regarding the Belgian part:
    very easy:
    – she goes to the town hall or town hall in her Belgian hometown. She must be at that service: Civil Registry. There she can obtain an official copy of her legal marriage.
    – have this copy translated into Thai, which is possible in Thailand, and have it legalized at the Belgian embassy in Bangkok.
    – take this to the ampheu, where she will stay in Thailand, and have it registered. This is accepted without problem.

    – the Thai part regarding name change:
That also seems simple, according to my information. She will best ask for information in Thailand for this.
I would advise you to have it determined and registered at the Belgian embassy, after the name change, that the Thai and the new Belgian surname are the same person. This document is available and necessary for further use such as with the pension and tax authorities in Belgium.

Now that I read this I realize that I have not been completely complete in outlining the current situation:
She has now been deregistered in Belgium and has returned to Thailand.
She is in possession of her marriage document and translation is not a problem.
Because she receives a pension from the Netherlands, she has to deal with the Dutch tax authorities, but only her own surname plays a role.
Incidentatlly …. Because she no longer has a (residential) connection with a European country, she has been granted an exemption from the NL tax authorities for paying taxes and social insurance contributions.

    That's not necessary Leon.
If she is legally married in Belgium, she can still adopt and use his name anywhere in the world.
She can take the marriage booklet with her in case of any uncertainties.
    European marriage is recognized worldwide.
