Home » Reader question » Reader question: Can I get into trouble with the police when I enter Thailand?
Dear readers,
I made a stupid big mistake. After a love story that turned out to be too good to be true, I found out when I got home that I had been tricked (own fault, big bump).
Now I was so angry that I sent 2 spicy photos of her via messenger facebook to a few friends of hers. Naturally, she is furious and offended.
Now I'm thinking that if she reported it to the police, I could still get in trouble at the airport of BKK, where I'll be back soon. By the way, she says no, because she doesn't want any trouble.
I know that prostitution is supposedly illegal in Thailand, and I have proof that she did it. Bank statements, photos and videos sent by her. Anyway, I'm farang, she a local so will be believed sooner.
So now I don't know what's sensible. Stay away for now? Many friends of mine laugh about it, they are real Thai people and say that the police do nothing with it and laugh about it.
I've never had trouble with the law, so what's the best thing to do to avoid problems.
Regards,
I
It is very unlikely that she has the contacts necessary to cause you trouble at the airport. I would try to avoid her environment.
Dear Jag,
You don't even have to do anything wrong to get in trouble with the police. This is a very recent proof: https://www.thailandblog.nl/leven-thailand/lezersinzending-woede-om-corrupte-politie-agenten-bij-alcoholcontrole-in-pattaya/
Now to the point: (men's) life is full of tempting pitfalls. Especially in Thailand. You come out for your story. Many don't. So don't think you're alone. On the contrary. No, luckily I didn't.
What is covered by the concept of prostitution in Thailand? I am convinced that this can be interpreted very broadly in Thailand.
This story as an example:
Many single male 'vacationers' ensure that they will not travel alone in Thailand. So they start dating over the internet for the first time. In Thailand they meet that 'pretty lady', with whom they 'travel around' in Thailand… Nice company, 'very useful guide' during the day and very probably also 'very good company in bed'. This will probably also ring a bell: have you become 'so close' with that lady at that point that you enter into 'a relationship' with it? Or is she offering her "friendly services" here. Because as a 'rich farang' you pay her for this: her accommodation, her food, her travel… After the holiday, 'the differences of opinion' prove to be too great 'to continue the relationship'…
Here I must admit that I also had such a short relationship in the first years that I had visited Thailand. I also gave her money for 'childcare', because someone had to take care of her daughter during her trip, who stayed with grandma… And yes, I also received racy photos of her, 'made by a friend of hers'…
Now comes the question: is that lady a prostitute or not? Where is the border? In my case, in retrospect, I actually consider it a (very small) bit…
But I'm still missing some details to fully answer your question: what did you find when you got back home? Did she have more relationships? Did she steal? Did you "misunderstand" her? Or was it something else?
You may want to avoid her environment. Do not disclose when you will be back in Thailand. Thais can go very far when it comes to revenge.
Maybe she won't do anything: Thais avoid (direct) confrontations to avoid losing face. On the other hand, they can be very sensitive and therefore mentally hurt, which means loss of face.
Actually, I can also laugh a bit, because you have proof of her: you can still enjoy her from the photos and videos 🙂 Hopefully she has nothing from you…
I still wish you many pleasant moments in Thailand. Make the best of it!
Regards,
Daniel M.
nothing will happen; as soon as she goes to the police she has to show the photos as evidence ……..what do you think? won't happen and if so nothing really, but she certainly won't show them !!
Stay away from her environment
Have fun on your next trip and tuition you have already paid 555
There is no chance that you could get out of trouble by threatening to report her to the police because she was a prostitute. If you threaten to do so, you increase the chance that she will report you for spreading her nude photos… then you really have a problem. Thailand has strict laws regarding abuse/defamation/libel over the internet.
However, I would be very suspicious of "By the way, she says no because she doesn't want trouble."
She may have already filed a report, she says she has not done so and hopes that you will come to Thailand again. You will be arrested and then she will probably want to withdraw the report for half a million baht.
See a case study here: https://forum.thaivisa.com/topic/1007842-frenchman-arrested-over-posting-nude-photos-of-ex-thai-girlfriend/#comments
She posted this villain publicly on her timeline. In addition, he had hacked her account, also punishable.
That is twice a degree worse, but what you have done is in principle punishable.
In short: I think you do have a problem! She sold her body for money, now she can try to earn much more with a declaration. Little effort! And 50% commission for the police.
Evidence of prostitution means little in Thailand.
And you only have proof of prostitution if you can prove that you paid money for having Sex.
Otherwise you don't have a leg to stand on.
And I doubt the police would feel compelled to prosecute that prostitution, even if you can prove it.
You can probably be prosecuted in Thailand for DIY photos, perhaps even with the computer crime act.
On the other hand, you have committed your crime abroad (from Thailand) and the question is to what extent this is punishable in Thailand.
A civil suit may be possible for defamation of her honour.
No one can predict to what extent you run the risk of being sued, it depends entirely on the lady in question.
Of course, such a crime committed from abroad against a Thai resident is punishable in Thailand.
Jag is wise to make it clear to the lady that he will never come to Thailand again.
Apart from the fact that not every prostitute is a guarantee that every Lovestory will break up, you should of course keep this possibility in mind.
To send her friends via messenger as aggrieved and then afterwards spicy photos, at least seems very immature to me.
Even your almost imminent declaration of her legal violation, in the event that you yourself could get into trouble in BKK, points to this even more.
First knowingly, if you write, using a so-called prostitution ban, and then playing the offended and reporting her unilateral violation to the police.
One-sided because knowing about this prohibition, you at least have a felt co-guilt to answer for.
It is not about whether you prove whether she is a prostitute or not, but about the fact that you have distributed racy photos of her to third parties via facebook messenger. And that is forbidden in Thailand!
You are not allowed to shame, blame, insult, or accuse anyone in Thailand.
(You are not even allowed to post an alcohol brand, bottle or similar on facebook)…
If she, or her friends, complain about this, you could be in trouble.
The guidelines for Social Media can be applied very strictly here in Thailand.
You don't have to, but you can!
I wouldn't be afraid of the police. From her family and acquaintances. Keep clear.
A nice comment that made me laugh.
You apparently also have a little bit of prostitution?!
Fortunately, according to police chief Apichai Kroppetch, there is no such thing as prostitution in Thailand!
Everyone can sleep peacefully again!
Prostitution is not supposedly forbidden, but totally forbidden. Action is varied, but usually not difficult to do. It is a big theater piece that takes place, while it is still a serious matter. But again there are people, including prostitutes arrested and punished for this. One of the methods that was used was to lure a prostitute into a hotel room and then, after a start of execution and discussing the amount, then make it known that one is from the police. Police called to the spot in drunken and disturbing situations at night in a hotel could also lead to arrests. But again it doesn't happen often and many make money from it, including corrupt police officers. As the others mention those pictures are your problem and what is wisdom. I think I'll stay away from Thailand for the time being and certainly from the places where that lady lives. There are plenty of other Asian countries, where prostitutes can be found for little money and the palm trees look the same everywhere.
This is now something you can't take back. I wouldn't take the risk, the chance that she actually did something with those photos seems very small to me. My advice is not to go to Thailand for the time being, you never know how it will turn out, and Thailand is now one of the countries where you don't want to have any problems. There are plenty of other nice countries.
The laws regarding defamation do not apply if you can prove that it is true. So if you can prove that she is a prostitute and has offered her services to you (which seems difficult to me), then that law does not apply. However, there is also the fact that you have both committed a criminal offense (renting the lady and the lady who rents herself)… I highly doubt that she will report it to the police and also that the police will even here does something with it, if she does... Then she will also dig her own grave. Plus the police will probably want money from her before they do anything. Personally, I bluff every threat here in Thailand with the statement that I have more money (which is usually the case) and can exert more power on the authorities if necessary...And that I want to see who comes out on top. in such a case... But besides that... Posting those photos was stupid... Thais are very vengeful and honor sensitive... They can react very unreasonably and extremely to even the smallest things... Good luck with it... I would just enjoy it flying... You certainly won't be going to jail for years... In the worst case, there will at most be compensation to compensate the lady... Because that is what everything here is about...
jag,
Have you apologized yet? Never hurts, if it's sincere.
There is little chance that you will have problems at Immigration or with the police. Ladies who walk the line are focused on pennies. By reporting the crime she loses time, has to confess, is viewed askance by the police and can get into trouble herself.
Even if the chances of you getting into trouble are slim, no one here can give you certainty.
What I do know: from now on you will look at things differently compared to Thai Police and Thai ladies.
Behind the smile lies the great danger. They are inscrutable.
However, it is important that you have sent photos to her circle of friends, you say, then she has lost face from those people and that hurts a Thai and they can and often want to avenge that.
I don't know what is advisable either, will in any case apologize to her but also to the person you sent and ask if they want to remove it and that the friends should not look angry at her but at you.
Succes
Apologizing won't help anymore, she's lost face.
Besides, she can also just tell the police that her ex boyfriend just posted nude photos of her. She is Thai and you are just a farang, according to the Thai way of thinking.
Not so easy to prove prostitution.
I'd stay away man.
The world is big, there are plenty of other and nicer places to discover in the world and Asia.
Let it be a lesson, I wish you continued success.
I would read Stephen Leather's book “private dancer”. This book gives a good look at the lives and loves of and with the girls from the bar.
