Can my mother's condo in Phuket be gifted to me?

Dear readers,

My mother bought a condo in Phuket last year. The intention was to put this in my name, but apparently she had already signed all the papers and it was a big hassle to change this after all. Is there a possibility that my mother will give it to me without having to incur too many costs (as in Belgium)?

I have been in a relationship with a Thai woman for 2 years now and we are starting to think about marriage and children. If we are married, could she claim my Thai property? And what about my property in Belgium? Can she also claim it if things go wrong in our relationship?

If yes, how can I best cover myself in an official way? For your information, we have both never been married and neither have children.

Please your advice.

    Your mother can put the condo in your name, the costs are not too bad. If that happens before your marriage, it falls outside the joint estate, just like other assets that you both amassed before the marriage.

    Before your marriage, draw up a contract with a lawyer in Thailand that your property in Belgium and Thailand will remain separate and that your wife can only inherit the Thai after death. If your marriage is good, you can still give your property in Belgium to your Thai wife, best also buy everything for your marriage that's how I did it with a Canadian Lawyer in Korat. You must then hand over the contract to the city hall at the wedding in Thailand so that it is included at the wedding.

      There is absolutely no need for a lawyer for that. This is straight forward, 'buy' from the mother, no research needed.
      Just go to DLT yourself.

    Very wise to cover yourself. How about having your mother make a will in which you are the heir. Then you also avoid crooked faces from your Thai family because you do not immediately put your apartment in both names. Well, your mother has decided that way and you now have plenty of time to really get to know your wife. Here a will costs 10,000.= baht.
