Reader question: Tax exemption company pension
Dear readers,
I have tried to read up on the tax exemption for company pensions. In the end I understood that the ID number in the yellow house booklet counts as a tax number for Thailand and can be used as proof of tax registered in Thailand.
My yellow house book will therefore be translated into English as proof of the exemption, if I have understood it all correctly?
My question is, should the translation also be legalized at the Dutch embassy?
I have also been completely deregistered from the Netherlands since the end of 2014. I also understand that I will have to have the company pension fully paid into a Thai account in order to qualify for full exemption under the current rules.
I welcome comments and suggestions.
Thank you in advance,
Hans
I don't know if your conclusion is correct.
The number in the yellow booklet is used by the Thai tax authorities, but that does not mean that you are also registered with the Thai tax authorities.
I had to do that separately and I received a certificate of registration from the Thai tax authorities.
Not an impressive document, by the way.
A card measuring something like 7cm x 7cm that had just rolled out of the printer.
Whether the Dutch tax authorities accept it is another matter.
I have the impression that this varies, although of course I can only speak from my own experience.
Proof of living in Thailand was accepted with me.
I registered with the Thai tax authorities later.
The civil service did not really feel like registering, because they often do not know how to tax foreigners.
That also seems very difficult with so many different countries with all different tax treaties.
Can someone tell me where I can register with the tax authorities in Hua Hin. Soon I will have to apply for an extension of the tax exemption in the Netherlands, always easy if I have that in hand.
Apply for a Certificate of Residence at Immigration and have this certified translated into English (both enclose). This is proof of registration for the tax authorities. You can also download and follow the form Request Exemption from Wage Tax from the website of the tax authorities.
Twice no.
The number in the house book is NOT proof of registration with the Thai tax authorities. Translating the book is therefore pointless in this context. The tax authorities ask that question to one person, not to the other; the requirement of registration with the Thai tax authorities seems to depend on how the wind blows…..
The remittance base determination requires that the company pension is transferred directly to a bank account in Thailand by the paying body. Your bank account in the Netherlands should therefore not be included.
Gentlemen,
thanks a lot for your responses.
I will report a request for exemption to KNT Heerlen and hope for a favorable wind.
Of course I will provide the necessary evidence of permanent and continuous residence in Thailand. (e.g. yellow booklet, Thai driver's license, marriage certificate, etc.)
If you have a Thai driver's license,
it would also include your name in English, date of birth, photo and your Thai ID.
Eric,
I deregistered in NL in 2006 and have been exempt from tax on my company pension ever since.
Both my state pension and my company pension are paid into my bank in NL and I decide when I transfer it to my Thai bank account.
Perhaps also falls under the chapter: “how the wind blows………. ? ”
Or is it another fabrication by the tax authorities to make things difficult for us?
It is a new regulation at the tax authorities, but it has been in the tax treaty art. 27.
LE Bosch, I have a 10 year exemption until I am 75. But after that I also fall into the other regime (or even earlier, one can withdraw an exemption…) and art 27 is brought into effect. It is also expected that the treaty will be revised and then all pensions from the Netherlands will be levied in the source country. It has already been noted that the current regulation is not applied consistently.
@Hans, with me there is only my name, date of birth, photo, but certainly not my ID, but my passport number and a number of issue of the card.
Everyone better read before you comment, one is talking about 2006 and that is exempt and the other is talking about 2014, there is 8 years difference between them and new rules have been introduced gentlemen regarding these pension forms, so just follow the new rules of the tax authorities in the Netherlands and you already write it yourself I have to deposit it into a Thai bank account from the Netherlands, and that's it, I've been here since 2005 and have also received exemption from tax levies.
I have been a tax resident in Thailand for several years now.
It is true that the number in your yellow tambian job booklet is the same as your registration number with the Thai tax authorities.
But it is not proof that you meet tax obligations here in Thailand.
After filling in my income both from here in Thailand and income in the Netherlands with the Thai tax authorities.
After checking, do I have to pay the tax here in Lamphun.
After this I have to report with the entire paper stall to the head office of the tax authorities of Northern Thailand in Chiangmai.
After approval , after about a month a document will be sent to me in English stating the amount and that I have paid tax here in Thailand at the tax authorities .
I will also receive a resident statement issued by the tax authorities.
This document is your proof , the name of this document is called Incometax payment certificate RO . 21
