MVV question: is my Thai stepdaughter's MVV still valid?

Dear Rob,

My Thai stepdaughter received an MVV valid until the end of March 2025. However, due to family circumstances, she returned to Thailand at the age of 20 and we had her deregistered.

She is now almost 22 and is homesick for her mother and would like to return to NL. Her MVV has never been revoked and is therefore still valid I think?

Can she return to the Netherlands with impunity?

Dear F.

Your stepdaughter was (after intensely applying for the MVV entry visa) in possession of a 5-year VVR residence permit, but unfortunately she returned to Thailand for a few years in the meantime.

In the event of a voluntary stay outside the Netherlands for longer than 6 months, the IND will state that the main residence is/was no longer in the Netherlands and will therefore revoke (or not extend) the current residence permit. 

If her VVR residence permit card has not yet been revoked, it will probably still be possible to travel to Europe with it. If necessary, check the personal data via the website of My Government (DigID required) and see what her BRP status and residence status are there.

In any case, even if she still manages to travel to the Netherlands, she will sooner or later have to deal with the IND. If they can prove that her main residence was outside the Netherlands, her residence permit will be withdrawn. 

My advice: consult an immigration lawyer for sound advice and a plan of action. Search via Google, look at the forum of Stichting Buitenlandse Partner (there are lawyers active on the forum, and there are various banners with good lawyers). Write to a few lawyers and see who you want to continue with.
