Dear readers,

When married in Thailand without contact, the marriage contract offered separation of property was not accepted by Thai municipal officials.

Is a change of marriage contract mandatory in Thailand or can this be done before a notary in Belgium? Both parties agree to change.

Thanks in advance with information.

Regards,

Jacques (BE)

    Jacques,
A first requirement is that a valid marriage contract is drawn up before the marriage takes place, this must then be translated by a translation agency registered by the embassy and ratified by a lawyer-notary in Thailand. At least… that's how it works in Thailand. However, it is possible to have your marriage regime changed in Belgium (if the marriage is also registered in Belgium, that is) by a notary, without the intervention of the court. You could therefore draw up a contract in Belgium with a notary, have the document translated into Thai (by a recognized translation agency in Thailand) and also have it legalized at the Ministry in Bangkok (Wattana) and legalized at the Belgian Embassy there . This is rather unusual, but given the circumstances, I believe it is the best solution for you.

You can have a marriage contract drawn up in Belgium and have it changed later, as often as you like, for example if children come along.

I am married with a contract drawn up by a foreign lawyer in Thailand and offered at my wedding and accepted without any problems because it is better and cheaper in Thailand, if you are going to do it in Belgium you also have to have everything translated and it will be much more expensive better go to a lawyer in Thailand who will be aware of what you should do

Dear Jacques, in TH please have the prenuptial agreements in order before the legal marriage is celebrated and submitted to the TH registry office. However, according to Thai Law Chap[ter IV Property of Husband and Wife Section 1467, a Marriage without to with Prenuptial Agreements can be converted through the intervention of the Court. Thus: find a TH lawyer and take the matter to court.
