Dear readers,

I married a Thai woman in the Netherlands in 2002, but I have always lived in Thailand (since 1995). We have been separated for 3 years now without a fight, but I want to get a divorce now because I want to return to the Netherlands in the near future.

What papers do I need from the Netherlands (I am currently on holiday in the Netherlands). And what should I do in Thailand to get a divorce there?

Regards,

Jos

Divorce in Thailand is the least of the problems. Go to the municipality together and arrange a divorce there. In my opinion, no documents are required from the Netherlands.

Dutch marriage is not considered legal in Thailand. If you have not registered the marriage in Thailand, you are not married under Thai law.
In that case, you only have to get a divorce in the Netherlands.

Is not true. Dutch marriage and Dutch divorce with a Thai national are and are recognized in Thailand. Must register with Amphur. Been there done that.

Well Cees, if you want to get married in Thailand, as a farang you must prove that you are not married in the Netherlands/outside Thailand to someone other than your Thai girlfriend. So that means that Dutch marriage is indeed recognized in Thailand.

The question is also whether you own your own house on "own land" in Thailand and or in the Netherlands or other valuables and on what basis you were married. My advice go to a good lawyer in the Netherlands with knowledge of Thai law and do the same in Thailand! Good luck

I also got married in Thailand and when we were at the town hall I asked what if there were ever problems and we wanted a divorce? They said, both come here with a marriage certificate and you will be divorced in 15 minutes. Of course, if you have registered in your home country have it changed back to Dutch and have the divorce registered in your home country.

a friend of mine was also married in pattaya and divorced there, it was a few years ago, it happened in 5 minutes he said and it cost him 200 bath and a coffee for his ex

It concerns a marriage concluded in the Netherlands and registered in Thailand. In that case, Dutch law will initially apply. Important is, for example, in community of property or prenuptial agreement. Do you have assets in NL or Thailand? As indicated earlier, look for someone with expertise. Send an email to the municipality where you got married to ask what is required for a divorce. For example, are both personally present or can she sign in Thailand and then send it?
Good luck and hopefully without too many problems
