My 20 year old son lives with me in Thailand, because his Thai mother passed away he has a non o visa for one year. He has now received a Thai birth certificate and now he is also Thai.

So I wanted to cancel his non o visa in his Dutch passport, but to my surprise they said at the immigration in Pattaya that he first has to cross the border with his Dutch passport and then re-enter with his Thai passport.

I find this very unlikely, now my question is is this correct? If so, where is the nearest border post? Then we can go there by car. Or is it wise not to do anything, then he is illegal as a Dutchman, but then legal as a Thai,

Who knows a serious answer to this?

  1. My lawyer has inquired at the immigration of the Cambodia border crossings.
  2. If he has his depart stamp in his Dutch passport, he must enter with his Thai passport, then the immigration says you do not have a depart stamp in your Thai passport, you cannot enter here.
  3. If he first leaves with 2 passports, they say, then he is not allowed. So how does he get a depart stamp in his Dutch passport?

    Your son apparently has dual nationality, Thai and Dutch, and therefore two passports as well as my son. It is always legal in Thailand and in the Netherlands/EU.
    You don't have to 'expire' that non o visa in his Dutch passport, he is a Thai citizen, no longer needs it and it will therefore expire automatically.
    He will soon leave Thailand with his Thai passport, must fill in a 'departure/arrival card' and will receive a departure stamp in his Thai passport. Why a departure stamp in his Dutch passport? (Last year, the Thai immigration forgot the departure stamp on my son, which was quickly and without problems solved on his return) and he returns to Thailand with his Thai passport. Depending on the country he is going to, he can show his Dutch or Thai passport upon entry.
    So I don't really understand what you're getting so worked up about.

      That's not right in my opinion. I have a son who is in the same situation and I have been dealing with this for a year. It seems unsolvable. He can't just leave with his Thai passport, because he CANNOT go anywhere with a Thai passport. Then he must have a visa for the country he is flying to (not the Netherlands, because he is Dutch - in my son's case: Belgian) but any other country, for example Australia, will absolutely not let Thai people leave just like that. The Thai passport is worth very little in the world. It is only good to arrive in Thailand. He can swipe it there, doesn't even have to go to a manned immigration check.
      So it is VERY important to keep the western passport in good order. My son is Thai, but has a one-year visa and has to have a check-up every three months (his Thai father does that for him). It's very annoying, but you absolutely can't let that go or he's lost his chance to travel out of the country.
      I would like to say to Yon: let your son fly out of the country and swipe the Thai passport upon entry. So you have no problem with a visa that expires in its Dutch pp

    Yes, it's very simple,

    Your son leaves Thailand with his Thai passport, enters the Netherlands or another EU country with his Dutch passport, leaves the Netherlands with his Dutch passport and re-enters Thailand with his Thai passport, at the airport customs on the right, in residents.

    It couldn't be simpler and that “O” visa simply expires.
