We have made a reservation for our stay in Hua Hin in January 2017 and have already paid for it at the Jaidee resort at Harm in Wierik. www.thailandblog.nl/hotels/jaidee-resort/#respond-title Now it appears that the resort is closed!

We have tried to contact Harm several times, also through his son and daughter (via Facebook) and have not received any response.

  • Do you guys know if it is true that the Jaidee resort is closed?
  • Do you know where we can file a complaint to get our money back? (about 1000 €)

    On Tripadvisor, Harm has responded to reviews a number of times in the past two weeks.
    If the contact details there do not help you further, you can perhaps share your experience there, then Harm will also respond, I think.

    For money back you can contact TAT, where the hotel (if it was operating legally) has deposited a deposit.

    I don't know the resort but it appears to be closed indeed.

      If I pay a hotel in advance, does that hotel have to deposit the money with the TAT? I do not believe it.

        No. As I wrote, if the hotel is affiliated with TAT, which is mandatory, then they have to provide a security deposit. In case of problems (non-compliance with obligations entered into by the hotel), customers can appeal to this.

    Dear Gino,
    Coincidentally I know that Jaidee no longer belongs to Harm and his wife Nipha… or at least when I was there 2 weeks ago they were busy selling everything.
    Nipha had approached me if I wanted to take over some stuff, which I did and they would go back to the Netherlands that Saturday.
    At that time, prospective buyers were looking around.
    I hope you get in touch with them and that you can just go because it is a beautiful and fun resort!

      I understand that they are selling the resort but if they are honest they could just return the money I already deposited in May 2016.

    Booking.com indicates that they do not accept reservations for Jaidee Resort.
    Initially it was, so who knows, other contact details may be available there

    So you may be 'screwed' (or so it seems, or he is simply bankrupt) and the best Harm may have left with the northern sun.
    Who knows, he may be back in NL.

    It is obvious to report this to the tourist police in Hua Hin, and try to find out through immigration where he now lives in Thailand or is perhaps back in the Netherlands.

      The police have nothing to do with this. If Gino cannot go to court in January, there is a breach of contract, but that is not a criminal offense, that is a civil law issue.

      We have already tried via Booking, but they only know that the resort is temporarily closed.
      It's just unfair of them to treat us like this, we were already 2x customer with them and now they 'put us in the bag'

    I don't know that just yet Fransamsterdam, after reading the various reactions here on this blog it is starting to lean towards scams. It seems to me that if payment has been made in advance, the manager should give a decent answer to questions from the hotel guest.

    Yep, it looks bad. On the other hand, the closure has apparently been planned, otherwise they would have had to evict the guests and that would have been noticed, or would have led to some reactions on the well-known assessment sites.
    It is conceivable that the business has been sold, including the reservations, and that the new owner will be open again in January.
    It is not polite not to respond to anything, but of course you also sell something to get rid of it.
    For the time being, it remains a guess as to what exactly is going on and I can well imagine that you fear that you will not see the amount paid again.

    It is of course a very strange thing that he does not respond to anything. It does not matter whether he has sold the business, because then it is normal that everything is neatly transferred and handled. However, this looks more like someone ran off with the Noorderzon. However, it seems to me strongly that this man cannot be traced further.

    In addition, I wonder that if you have booked for that resort, then legally speaking nothing will change if there is a change of ownership, right? You have a contact with that resort and not with that Harm in person, right?

      For example, if it is a BV, then that may be legally the case, at least that is the case in the Netherlands (I have had something like this myself: after the death of the owner, the new owner thought that the lawsuit I had filed against the BV was not They did not defend themselves and my claim (which was considered reasonable by the judge) was granted with a hammer blow.

      If it is a sole proprietorship, then it is different, then the new owner is probably not liable, although that ut leniency could help Gino something.

      Given the fact that Harm te Wierik did not contact Gino of his own accord, it can be concluded that Te Wierik is cheating or has no money. Any decent person would contact us to find a solution together.

      What I would do first: find out where he now lives in NL, send a letter in which you (assuming he has no money, but will soon find a job again) propose a payment arrangement of at least 100 euros per month, with the threat that you otherwise call in the police and/or start legal proceedings (with a possible attachment of part of his wages and costs of the procedure for him).

      What I once did (a loan that was not repaid): contacted the employer directly (in my case, that employer arranged this quickly and very correctly).
