Reader's question: Lawyer wanted to handle inheritance and sale of deceased father's house
Dear readers,
My father with Dutch nationality lived in Thailand. He had 2 houses to his name and recently passed away. We would like to sell the homes (as heirs), but because of corona it is difficult for us to go to Thailand.
The houses are inhabited, but we do not know by whom. It is now illegally rented by his ex-girlfriend and she has blocked us. This situation has been going on for over 1,5 years now. We would like to engage a lawyer who can help us transfer the property to our name and sell it.
We notice that it is difficult to find a reliable lawyer who is easily accessible and who charges fair prices.
Unfortunately we have not had a good experience so far. It concerns a house in Phuket and Phrea and a car that is still in Phrea, which is now also used and has to be sold.

As the 1st question, how did your father have the houses registered? lease contract or company first you will also have to arrange power of attorney.

The car is indeed in his name, houses too, land is not. A name would be nice indeed, maybe we can inquire with them. Do you have experience with them?

I don't mean to be rude, but you can't solve this easily. Without knowing the ins and outs, for example, was there usefruct or are the houses housed in a BV (LTD), I can tell you that you cannot solve this without proper legal assistance. Get a lawyer right away, that will save you unnecessary extra costs. A few options have already been mentioned, even one with a Dutch-speaking lawyer. You should also go to a civil-law notary in the Netherlands for a deed of inheritance. Costs around 300 euros. If there's no will, which I understand, you'll need one anyway. Must also be translated by a sworn translator.

Very strange that your father has a house in his name. At least not the ground, because that is not possible in Thailand. When looking for a lawyer, look for one in the area where the house is located and not one who lives hundreds of miles away.

Please do not have inheritance law done by a notary for this case, it is not recognized here. This is a basic case for inheritance court.
