Dear readers,

I have a question about reporting taxes. I will get almost €7000 back in tax for 2022. This is from my PMT pension, I do not yet have an AOW. And I haven't filed a tax return here in Thailand. Is it wise to still file a tax return? Or should I just wait and see?

I would like to hear if anyone has experienced this.

Thank you in advance.

Regards,

Wim

Wim, PMT, Metaal en Techniek, seems to me to be a company pension and that is taxed in Thailand under Article 18 of the treaty. Then you are obliged to file a tax return in Thailand if, after emigration, you live in Thailand for 180 days or more in any year. Doing nothing is unwise because you are violating Thai law and could be fined or worse.

You are reporting the portion that you transferred to Thailand in 2022, so check your bank account carefully. Then immediately file a tax return for 2023.

Correct with the exception of the transfer.
Remittance in short that is only levied
    pension transferred to Thailand
is incorrect. Misreading of the Treaty with Thailand.
The pension has been allocated to Thailand for taxation
    , transferred or not”.

Gerritsen, I don't see 'transferred or not' mentioned anywhere in the treaty.

Look at Thai law: remittance. If the Thai service acts like this, that's fine. The rest will come a year later. Otherwise you will end up in a situation where the money received from an old year is taken again the following year, especially if you meet another official. Go and explain that to them!

Let it be as Thai officials are used to. The day requirement also differs in law and treaty...
