TB Immigration Info Letter No 004/22: Immigration Jomtien/Pattaya – Year Extension Retired

Recognizable? You name it. Sometimes there are things that play in your head and then it is pleasant or necessary to talk or write about it. An anecdote written from life. In my case, the annual recurring ritual of the “retirement extension” had been discussed.
As most of us know by now, a similar battery of copies of documents must be made and shown every year before the stamp will be placed in the passport. A totally unnecessary theatrical event, which is unparalleled and which causes stress for the necessary applicants.
The application, regarding the financial part, can be done in three legal ways for an unmarried person with a Non immigrant O visa:
– Through the 800.000 Thai baht in a Thai bank account
– By demonstrating the income requirement of at least 65.000 Thai baht per month in a Thai bank account (only required for the application based on the Non-OA visa) or via a form (income statement, including pension and or AOW) at the Dutch embassy in Bangkok or Austrian consul (Mr. Hofer) in Pattaya. You only have to show an amount and nothing about the actual use (import) of this in Thailand.
– Through a combination of the top two and then a part must be declared through a Thai bank account and income through the Embassy or consul.
For years I used the services of the Austrian consul at immigration in Jomtien/Pattaya and the cost of this form is currently about 1610 Thai baht.
According to information, the applicant's income in Thailand can also be explained and proven by having a bank statement made from him or her with confirmation of these documents by the Thai bank itself. The costs for this vary between 200 and 300 Thai baht. For this method, an open-minded Immigration police officer must agree to it at the time of processing.
In order not to spend money unnecessarily and because in this banking way you actually demonstrate that you bring at least 65000 baht into Thailand, I had all documents drawn up through my bank and thought I could make the application with this. But yes you never have certainty in Thailand and certainly not if money can be involved and if there is no lack of tunnel vision by the relevant practitioner. So today I was a bit uncertain waiting for my seat. Fortunately I was not the only one with uncertainty, because the mood was cut again. Half past ten I was inside and there were still 8 people in front of me and they had to be dealt with before half past eleven, because then there is a one and a half hour rest and meal break for everyone in the building. The possibility of deploying the staff half and half (45 minutes for each group) and as such not having to close the toko has apparently never occurred to this group of officials.
Various applicants received comments on their application documents and were sent away with assignments. Fortunately, the only support officer who looked at the files of the applicants could still count on the support of a police officer dressed in a yellow polo shirt without rank insignia. This older man, with round glasses and gray and therefore not colored hair, was the last person to look through my documents before the break and he said to me “you are coming to demonstrate your income in Thailand with a bank statement.” I confirmed this. It turned out that I did not have a document available and that was a document that the bank needs to make when issuing the annual statement, which contained a bank confirmation whether I, the person of the passport and the Thai bank account are one and the same person. So something like prove that one and one equals two. Surprise, of course, because I had my valid passport and valid Thai bank book in my hand and documents had already been sent to me in this regard by the same bank. There is too much information and the bank employee can only exercise control in a similar way to that police officer, by using the eyes.
But yes, I thought not to complain too much and just do what is asked, otherwise there were no objections raised by this policeman. I go to my bank branch for the requested document with a covering letter, drawn up by that police officer. It was known to the bank clerk and for 100 Thai baht I was the man. Upon closer inspection of the bank statements, I saw that a similar document had already been drawn up by my own bank branch employee, with exactly the same Thai text and form structure. So now I had two and yes double sewn holds better.
After 13.00 pm I could come back to immigration and then hand over the paperwork and passport with the 1900 Thai baht. Thus happened. The policeman who had looked at my file was not there when I returned, only the support officer and he came to a different conclusion. I could not make this application with the bank papers, because for Dutch people the Austrian consul Mr. Hofer must be used. So I had to have the appropriate document of about 1600 Thai baht drawn up again based on my pension data. As we know, this cannot be checked with certainty (after all, I come with copies of my pension fund) and no inquiries are made at the Dutch pension institution by Hofer and his vice consul, who are not authorized to do so.
This aside and let's be happy that this option is offered and I think it is the same at the Dutch embassy in Bangkok. They will also not have a hotline with the pension fund and will certainly not receive information without my permission. It also says something about my pension in the Netherlands and that is sufficient for the application, but it does not show in any way that I have at least 65.000 Thai baht in Thailand, which I must demonstrate in accordance with the choice I made for applying for retirement extension through the bank method. The support person told me that he only follows the instructions and he cannot deviate from this. When I asked who can do this and who I can speak to about this, he said: “my boss and he is in the corner at the back of the building”. To my surprise, it was the same man who had gone through my file. I approached this man and nodded politely (the Wai applied), did so in accordance with the usual archive in this and the documents submitted, which shows everything and in my opinion the year stamp can simply be provided, provided he agrees.
From a distance I overheard the assistant informing his boss about the arrangement with the Austrian consul, Mr. Hofer. Then a light went on with the best man and he spoke the wise words that this was indeed the case and that as a Dutchman I can only do business through the consul or otherwise no departure and a one-way ticket to the Netherlands. Go to Hofer, Hofer was what he chanted. According to him, there were only three countries where the bank construction went ahead and that was America and the other two did not stick (probably England and Denmark). I had become quite irritated by now, because I had noticed that consultation with him was not an option. All efforts made so far have been in vain. He used some hand gestures that unmistakably invited him to leave the building, because he didn't want to talk any further. However, another policewoman (whom I had not mixed into the conversation) thought it necessary to inform me about the 800.000 Thai baht scheme and in such a way that I did not give my opinion about it.
I did have to say to the police chief that I myself was the police chief of the aliens police in the Netherlands of a similar open-plan office as can be seen in Jomtien and that the manner of treatment in this was disrespectfully conducted by him towards me and that the failure to answer my the question why the Hofer route had to be taken and he is not in favor of me raises the necessary questions. In my view, sometimes exercising discretion, which certainly applies in Thailand, is an option to consider. (In Dutch administrative law, a discretionary power is a power that grants an administrative body (such as the police through certain appointed employees) the freedom to a greater or lesser extent to take a decision in concrete cases as it sees fit.) Yes, I know , it is the strong shoes that can bear the wealth and it is not given to everyone. At the time, I sometimes used it incidentally, because even legal rules do not always cover the load. This police chief also said that this was Thailand. As if I was not aware of this and certainly now looking at him like that.
With the realization that it fell on deaf ears, so tomorrow I go to the Austrian Consul, Mr Hofer and tap off the 1600 baht for a document that is produced in 2 minutes. Still a significant advantage compared to applicants with the Non OA visa, who, in the way I advocate, are also required to demonstrate the minimum income of 65.000 in Thailand. In addition to the fact that with the Non OA, health insurance must also be demonstrated, which is therefore not the case with the Non O.
There are times when I wish I had rose colored glasses and this was one of them. Would have saved a lot of aggravation. But something in me thought it necessary to try this out. However, all the effort and wasted money turned out to be for nothing.
In hindsight I should have known better because nothing is what it seems with this instance and our queen would have said "he was a bit stupid." Let me be ahead of some critics and the difference between 1600 and 300 Thai baht is not that I will end up penniless. It could also be, but yes that is not proof, that a certain financial component is also part of the Hofer construction (a considerable amount is involved) and you do not want to deprive the poorly paid police officer and Hofer of that. On the other hand, the amount at the Dutch Embassy in Bangkok is also so expensive and of course I do not suspect corruption. Considering this, I'm probably wrong (professional deformation), let's just leave it at that.
I now have the overvalued stamp in my passport again and I can stay for another year. What kind of income statement at the consul can yield happy faces for three parties. Everyone is happy and healthy again tomorrow.

Still some addition to what the official rules according to the immigration order say.

With regard to monthly deposits as Retirement, the order does not distinguish between a residence period obtained with an OA and an O. The financial requirements and proofs should be similar. (see order)

In the text in the order, only the USA, UK and Australia are cited as examples (Such as) of countries that no longer issue Affidavit. Nowhere is it written that this means that only those countries can use the deposits.
“….due to the fact that embassies of various countries such as United States Of America, United Kingdom and Australia have canceled the issuance of income certification letter to their citizen since I January 2019,…”

Oops that is a hefty accusation towards Mr Hofer Consul of Austria, hope you don't read it because then you can really get into trouble!!! Hofer construction (a considerable amount is involved) and that is what you want the badly paid police officer and not deprive Hofer!!QUOTE!! I can share more photos of me at immigration than I still have of myself. Dear Casper, I am not accusing anyone, but I have my reservations that I commit to paper. There are a number of options to consider. There is an essential difference. I also indicated that the Austrian consul is not on my suspect list and will never accuse anyone without proof. It does, however, raise questions for me. My grievance lies with the behavior of the immigration police in Pattaya and then of course with the persons concerned. Not everyone is the same. I myself have always (for years) quickly finished my application, because I always used the income statement. I wanted to get rid of that (I prefer to spend the 1300 baht difference on something else) and legal options have been given to use it. Also the sofa construction. People don't want to hear about that. I had to go to Hofer. The why question remains unanswered. My extensive piece has to do with my experience, I just wanted to say that and immediately the question whether others can explain to me why an application submitted on a legal basis is not honored there. I hope you have an answer to this so that there will be clarity.

Well I can explain that to you. The immigration is on a top floor only accessible by a large staircase. I am currently in a wheelchair due to Jight from my foot. My wife had a letter from the hospital that was sufficient and by the way I am coming from there start that it is open that immigration office they know me by now from Passport with 2 recent passport photos. And is always treated correctly no problem Johnny. And another thing my wife had a photo on her phone from a visit to the hospital it was like my wife says not easy to convince the imm. but it did won't go in other places like pattaya ??? .

Another note for the suggestion box at immigration not to discriminate against people without disabilities. Actually, the embassies should argue that it does not fit in with the Glasgow climate that Thailand would also make an effort for. A thick paperwork and many less travel movements is the simplest step.

Every year I have to have an annual statement made by Kasikornbank regarding the completion of my Thai tax return.
This printout is mandatory, otherwise the official will not complete your tax form in February.
Question: is a COPY of your Thai tax return and a copy of Kasikornbank's annual printout not sufficient to demonstrate the amount of pension you have transferred to Thailand.
Previously I have always used an 800.000 bath deposit account, but with the current only 0,4% return basis, I now also want to submit my occupational pension for the first time with an extension of retirement visa.
I then only have to keep a balance of 300.000 bath in addition to my 700.000 bath occupational pension.

There people are charmed by the 800.000 baht construction. That was recommended to me in an imperative singular way, together with going to the consul of Austria and Germany, while for the Dutch there is the embassy in Bangkok, which should be thought of first, but is not referred to. For me, the 800.000 baht construction is not attractive. I am already a day older and how long to live is the question. So I like to spend my money and I am not from the club that takes pleasure in a bank book with this amount on it. Great for the bank, but I don't feel responsible for that either. Another afterburner that may have an impact on a possible application in your proposed way:

There are immigration offices that use the combination method based on the bank amount.
In that case, immigration offices usually require that the bank amount is a minimum of 400 Baht and you may not go below that throughout the year. The same is actually applied here as with the 000 Baht bank amount, where you are not allowed to go below 800 Baht throughout the year.
You may then supplement that amount of 400 Baht with an income, which together must be at least 000 Baht on an annual basis.
Therefore, find out what applies locally if you are going to use that method

You live in Thailand. Behave according to the rules. You are Dutch. If you comply with the rules, you can request the income support letter from the Dutch Embassy. You will receive this statement within 14 days.
If you, as a Dutch person, turn to an Austrian consul, you are already starting to walk on thin ice.
If your income is good enough, you don't have to worry with the Dutch support letter.
The cheating via the Austrian consul is asking for trouble. The Thai imm. Officials know that. And use that to humble you.
And know that an immigration officer must be convinced that everything is correct. Otherwise he won't give you a stamp. He can then impose all kinds of preconditions on you.
This is Thailand and not the Netherlands.
But the IMI official must also comply with the rules.

Dear Jan, I have indicated in my piece how I think about it. I assume that the consul is not cheating because the amounts that are asked for making such a document are fairly similar to those of the Dutch Embassy. However, I am suspicious enough not to rule out a back door construction, in which the initiative certainly does not come from the consul. But I'm happy to trade my twisted thoughts for a plausible explanation. I am concerned with the behavior of the immigration police themselves. I've never had any problems with Mr. Hofer and his Vice Consul. Always treated nicely and kindly. I am glad they provide this service. My approach for the extension application of the week was according to Thai guidelines, but is not accepted by the immigration police in Pattaya. They too must abide by the rules, but apparently feel elevated. The why question is still unanswered.

Dear Janderk, I would like to advise you to go through my piece again. If all goes well, you should come to a different opinion. If anyone follows the rules, this is it. All my life. Nothing but praise for the new Dutch ambassador, I was called by an employee asking if I would like to receive my documents by express or regular mail.
Difference in price but faster, so I took the express and within 10 days everything was sent (by me) and my documents received from the embassy.
Good service from the Dutch embassy and no problems at Immigration except for some extra copies that were made on site.
Friendly service as usual, so all credit to the officials in Chiang Mai.

On Tuesday morning January 18 to Dankhuntod post office for my application visa support letter to embassy stamped as fast mail and the envelope for returning also stamped as fast mail.
At the end of the morning on Friday, January 21, the postman was in my garden with the visa support letter.
Dear Jacques, it is good that you have checked whether there are other roads to Rome. Unfortunately, they thought otherwise at your immigration office. There are officials who can be real nitpickers (I actually wanted to use something with ants), or give their own pendulum to the rules or stick to old procedures (“that's how I've been doing it yaaa-ren” and then have no mind whether the rules or technology have progressed in the meantime). I can therefore imagine your frustration if you come across a civil servant who does not opt within the rules for what the purpose of the law is (checking whether the foreign national has sufficient financial resources), but opts for rigid (?) internal/ local guidelines.
Such a remark as “this is Thailand” can be freely translated to “stupid foreigner, I am superior to you, you don't like it, then fuck off”). Too bad, but keep your cool, give the officer a sarcastic smile and leave the building. Those who don't dare, who doesn't win, who knows that TZT will find out how the government can control and at the same time not make things unnecessarily difficult for themselves and the citizen. I don't like the type of rigid or haughty official / agent, so between the lines ( 😉 ) I get the impression that you were an official who does not fit in that street. Thank you Rob, and indeed I have always been a servant, the helping task suited me best, but I was not afraid to step up when necessary. There are (legal) limits. We are in this world to help each other, aren't we? Many think otherwise and this is yet another proof.
Suitability far from that and I had long had an entertaining performance conversation with a colleague who approaches people in this way.
Some addition about what can be found officially about 2 things.
1. Do I have to appear in person?
A long time ago they changed some forms. Since then you can read the following on the TM 7 – Application for extension of temporary stay in the kingdom form at the bottom.
“Applicant must submit the application in person with the exceptions of handicapped patient or persons with disabilities””

This would mean that you would not be required to appear in person if you are a person with a disability or disability.
The person who does it for you will probably have to provide the necessary evidence why you cannot appear in person due to that disability or limitation.
2. Is proof of taxes allowed?
I don't know if anyone bothered to read the link I posted earlier to supplement the notice, but it also mentions a "personal income tax form together with the payment slip."
In that note it is only mentioned with a Thai Marriage/child but not with Retired.
For example, the Thai marriage/child section reads:
Procedures: I ) A personal income tax form together with the payment slip.
In principle, one should then already be allowed to accept it for a Thai Marriage/Child.
That is what is officially stated with regard to those 2 matters. How it is applied locally is probably another story.

You already start your story from a completely wrong attitude: an extension of the year does not have to cause STRESS and that it is a completely unnecessary theater, well that is your own point of view. Who are we to determine that a regulation, by a country where we reside and is NOT OURS, has superfluous regulation?
As a former civil servant, you should know that they comply with the applicable regulations and you are also expected to know the rules. It is also known that for applications from which their embassy still provide an affidavit or a letter of support, it is accepted everywhere and they cannot use a printout of sums transferred to Thailand, so there you are also in your detailed and superfluous long-winded writing already wrong.

The method of application that I have currently made is in accordance with the regulations in Thailand. Read the information again carefully. The unwillingness to not grant the application in this way raises questions and certainly the behavior of these and some officials at this office are far below par. Not just to me but to many who apply. Some do not understand much of all the things that need to be provided and they get a hard time. It is a civil servant position that should also be serving in Thailand. The arrogant attitude is dripping from it. Corruption has been going on at this office for years and people sometimes don't make a fuss about it. Who makes them what. Many Dutch people think it's great to get something extra out of the tax authorities or to pay as little as possible.
No one here is more Catholic than the Pope. A matter of live and let live instead of always pointing that corrective finger.

Thai resident for 25 years and never any problems with immigration. Make sure your papers are in order as they should be, your personal vision is unproductive. You stay in their country and not in the Netherlands!

The point is that one only acts according to one's well-being and one's own interpretation. There is also such a thing as acting according to the spirit of the law, in addition to the letter of the law. So something that is not written would be wrong by definition.
